Terms of Service

Welcome to YAYChiro. These Terms of Service ("Terms") explain the rules for using our websites, apps, content, community and services. By purchasing a membership or using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Who we are

"YAYChiro," "we," "us" and "our" mean YAYChiro, doing business as YAYChiro. "You" means the person who purchases the membership.

2. What your membership includes

A YAYChiro membership gives you access to Campaign Flow Monthly, AdMentor, our marketing content and templates, help setting up funnels and webinars in Systeme.io, and the YAYChiro community (together, the "Membership"). Features may change over time as we improve our services.

3. One person, one practice, one subscription

Each Membership is for one person and one practice or business. One subscription covers one account holder and one practice. It may not be shared, split or used for other businesses.

  • Your login and access are personal to you. Do not share your login details with anyone outside your practice.
  • Team members who work in your practice may help prepare marketing, such as ads in AdMentor, under your account. You are responsible for everything done under your account.
  • If you own or manage more than one practice or business, each one needs its own Membership.

4. What you may not do

Our apps, content, templates, checklists, workflows, prompts, designs and community materials are our intellectual property. You agree that you will not:

  • copy, replicate, clone, reverse engineer or recreate our apps or any part of how they work;
  • resell, sublicense, redistribute, share publicly, or white-label our apps, content or templates;
  • use our materials to build, train or market a competing product or service;
  • use bots, scrapers or other automated tools to access or copy our services;
  • give access to people outside your practice, or use your Membership for other businesses; or
  • use our services for anything unlawful or harmful.

You may use our templates and content to market your own practice. That is the purpose of the Membership.

5. Your content and our content

You keep ownership of the information and content you enter into our services, such as your practice details, offers and ad text. You give us permission to store and process it only as needed to provide and support our services. We keep ownership of the apps, templates, content and everything we create.

6. Your marketing and compliance

We provide marketing tools and education. We do not provide legal, medical, regulatory or compliance advice, and we do not guarantee any results, patients, leads or income. You are responsible for reviewing everything before you publish it and for making sure your marketing follows the laws and rules that apply to you, including your state chiropractic board rules, advertising and truth-in-advertising laws, email and text message laws, and the policies of platforms like Google, Facebook and Instagram.

7. Patient information

Please do not enter patient names, health records or other protected health information into our apps, forms or community. Our services are not designed to store that information, and we are not your HIPAA business associate.

8. Payments, renewals and cancellation

  • Memberships are billed monthly or yearly, depending on the plan you choose, and renew automatically until you cancel.
  • You can cancel anytime by emailing support@yaychiro.com or using the cancellation link we provide. Cancelling stops future charges, and you keep access through the end of the period you have already paid for.
  • Payments are handled by third-party payment processors. If a payment fails, we may pause your access until it is resolved.
  • We may change our prices. We will give you notice before a price change applies to your next renewal.
  • Prices do not include any taxes that may apply.

9. 30-day money-back guarantee

If the Membership is not the right fit, email us within 30 days of your first purchase and we will refund you in full. After the first 30 days, payments are non-refundable, except where the law requires otherwise.

10. Virtual assistant services are separate

Our virtual assistant (VA) services, such as editing and posting videos, scheduling content, updating slides and light webinar edits, are sold separately and are not included in the Membership. VA services are provided under the scope, hours and timing described when you purchase them. You agree to provide the materials needed, and you confirm you have the right to use any videos, images, text or other materials you send us.

11. Community guidelines

The YAYChiro community is a supportive space. Be respectful, do not spam or promote your own products or services, do not share other members' information or our materials outside the community, and do not post anything unlawful or offensive. We may remove content or members who break these rules.

12. Third-party services

Our services work with other companies' products, such as Systeme.io, social media platforms and payment processors. Those companies' own terms and policies apply, and we are not responsible for their services.

13. Changes and availability

We may update, improve or remove features, and we may occasionally pause services for maintenance. We work to keep our services available but cannot promise they will always be uninterrupted or error-free.

14. Ending your access

You may stop using our services at any time. We may suspend or end your access if you break these Terms, share your access, copy our materials, or misuse the community. If we end your access for those reasons, we are not required to give a refund.

15. Disclaimers

Our services are provided "as is" and "as available." To the fullest extent the law allows, we do not make promises or warranties about results, accuracy, availability or fitness for a particular purpose. Any suggestions generated by our tools should be reviewed by you before use.

16. Limit of liability

To the fullest extent the law allows, YAYChiro will not be liable for indirect, incidental, special or consequential damages, or for lost profits, patients or data. Our total liability for any claim is limited to the amount you paid us for the Membership in the 12 months before the claim.

17. Your responsibility to us

You agree to cover claims, losses and costs that come from your marketing content, your misuse of our services, or your breach of these Terms.

18. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to conflict of law rules. Any dispute will be handled in the courts located in St. Mary’s County, Maryland.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version here and update the effective date. If you keep using our services after changes take effect, you accept the updated Terms.
